CC&R Enforcement
The Association has been subjected to several
incidents over the past year that are violations of CC&R’s. These
include, for example, failure to landscape, underage renters, and
operating a business. Action has been taken by the Association in
the case of every confirmed violation, but in a few cases the
residents are seeing little results. This is a very small
percentage of the 6,200 homes in the community. However, it is a
concern that must be nipped in the bud. Sun City is the best place
to live. Let’s keep it that way!
State law prohibits the Association from discussing actions taken
against an owner with another owner. Consequently some residents
are engaged in discussions with a common theme – who can they
blame? Who can they be upset at? Let’s see if this article can
focus your energy in the right direction.
Without trying to be too technical and use lots of legalese, there
are things that the Association cannot do. It cannot evict
renters, no matter who they are or what they do. The City can
under certain conditions, but the Association cannot. The
Association cannot foreclose on the homes of owners, unless they
do not pay assessments. The foreclosure process takes a long time
and is governed by Nevada statutes.
What can the Association do? First, it must operate within state
and city laws. Failure to do so could result in lawsuits that
every resident will have to pay for as part of their assessment.
Nevada statutes state that the Association can fine owners and
restrict their privileges (use of facilities). The Association can
also fine renters, and if they don’t pay, their fine is
transferable to the owner. The Association can put a lien on the
property for non-payment of fines, but cannot foreclose on the
lien. The Association will get its money when the property is
sold. The Association can also enter a property, complete the
landscaping and bill the owner for the work. But then the
Association will take on the responsibility for maintaining the
landscaping. The Association’s attorney has advised against taking
on this liability.
So, who can residents blame?
- Owners who rent to non-qualified people.
- Owners who sell property via quit claim deeds
to non-qualified buyers in order to avoid scrutiny.
- Owners who allow real estate agents to
advertise and sell to non-qualified people.
- Real estate agents who sell and / or rent to
non-qualified people.
- Title companies who do not verify the age of
buyers.
- The State Legislature has tipped the scale in
favor of homeowners and renters, against Associations.
The Association has hired an Enforcement
Manager. Christine Wikoff will organize an effort to identify
every resident and owner of the 6,200 homes in Sun City. Armed
with the data, the Association will re-enforce the CC&R’s (the
Association has been enforcing the CC&R’s, but this will result in
an increased in effort. Real estate agents and title companies
have been contacted twice and informed that Sun City is an age
restricted community and that they should advertise it
appropriately and sell only to age-qualified persons. Changes to
the Association’s Design Guidelines and Rules and Regulations may
be made to strengthen advertising regulations. Then the Licensing
Board can be contacted by the Association, with requests that
violators be sanctioned.
What can you the residents do? Request changes in our laws.

Contact your State Assemblyman (Scott Sibley at

or 930 4th St. Suite 100, Las Vegas 89101). Let them know how
unhappy you are that the laws don’t provide you with the same
level of protection that is afforded the homeowners and renters
who violate the CC&R’s with impunity. Offer suggestions to allow
Associations to enforce CC&R’s with penalties through court
actions that will cause the necessary changes in behavior. Get
involved with the Community Associations Institute’s Political
Action Committee that lobbies the State Legislature on association
type issues. And support the Board in its efforts to change the
statutes.
If you see criminal activity (for example, trespassing, theft of
grocery carts, etc.), call the Henderson Police Department at
(267-5000). If you see children being abused call Child Protective
Services at (399-0081). If you see the need for enforcement of
city code (such as for health and safety), call the Enforcement
Manager, (Dan Emry at 267-3957). In these cases the Association
has no authority, but if contacted, refers any call to the proper
city authority. These authorities have and will act appropriately
regarding violations of city code, which may give some relief to
the residents.
The Board of Directors does understand the concerns of the
residents and is doing all that it can within its legal authority.
With the approval of the hiring of the Enforcement Manager, the
Board is saying that it cares and wants to do what is right for
the residents.

The
Minuteman Foundation is the
organization which provides the funding needed to support the
activities of the Community Service Club. The Foundation is a 501
(c) (3) charity.
The goal of the The
Minuteman Foundation is to
fund the many and diverse needs of the elderly in each and all of
our growing communities.
Pursuant thereto we have allied with the Community Service Club to
provide free assistance to SCA residents.
The services included are:
Transportation: To local
area medical providers or supermarkets. Three (3) business days
notice required to arrange for your ride.
Equipment: We will loan you (on a temporary basis) a
wheelchair, walker, crutches, cane, or other durable medical
equipment.
Home Maintenance: Assistance with minor home maintenance
chores such as: cleaning or replacing overhead air filters,
replacing batteries in smoke alarms and carbon monoxide (CO)
detectors, or changing overhead light bulbs.
Home Assistance: Resource Directory of information on
fee-based, discount, and many other services available to seniors.
Volunteers will also shop and deliver groceries or prescription
medication to residents who are temporarily homebound.
Support Groups: CSC sponsors several support groups to
assist the residents of Sun City Anthem. These groups are:
