The Pension Protection Act 2006 — Charitable Gifts

On August 17, 2006, President Bush signed into law The Pension Protection Act of 2006. This law allows you to use funds from your IRA to make a lifetime charitable gift, tax free.

Your benefits:
These distributions to charity can count toward your required minimum distribution without being included in your income. This point is important because it could potentially:

  • Decrease your tax on Social Security payments.
  • Increase the amount of deductible medical and miscellaneous itemized expenses allowed.
  • Decrease the alternative minimum tax (AMT) exemption lost to phaseout (for those subject to AMT.)

Fortunately, these gifts can be accomplished simply and without tax complications. You can save big dollars on your taxes and make a major gift to the Minuteman Foundation. Married persons with separate IRAs can each transfer up to $100,000 between now and December 31, 2007!

Of course, there are some "ifs:"

  • You are are 70½ or older, or will turn 70½ on or before December 31, 2007.
  • The gifts do not total more than $100,000 per year
  • You make your gift on or before December 31, 2007
  • You transfer the funds directly from an IRA or Rollover IRA to a qualified charitable organization, such as The Minuteman Foundation.
  • The gift must be outright. It cannot be made in exchange for a charitable gift annuity or other life income plan

Donors must contact their IRA administrator for the forms necessary to transfer gifts directly to public charities. For those of you that pay State income taxes, you should check to see if your state law follows this federal law.

For more information:

You should consult with your tax advisor for your particular circumstances when considering the gifting of these types of  assets.
