Kitec update!

Favil West interviewed Patrick Auld, Division President, Pulte Homes, on the Presidents Report. The subject was the ruling by Judge Williams regarding the Kitec issue. The full interview will be shown on channel 99 beginning Monday, March 26th. The following are Mr. Aulds comments:

A statement from Pulte Homes

Dear Sun City Anthem homeowners:

On March 14, District Court Judge Timothy C. Williams, the judge presiding in the Kitec/Ipex class action lawsuit, issued a ruling invalidating portions of the monetary offer Pulte Homes made to residents of Sun City Anthem regarding their Kitec plumbing systems.

We disagree with the judge's ruling and are in the process of reviewing this issue with our legal counsel to determine our options.

Pulte/Del Webb is not, and never has been, a party in the class action lawsuit against Ipex. We believe our compensation offer of $7,800 to homeowners complied in all respects with Nevada’s Notice of Repair statute (N.O.R.) NRS Chapter 40. In addition, we believe that our offer is entirely independent of the class action lawsuit.

The N.O.R. statute is designed to provide a process for homeowners and builders to resolve construction disputes without the need for lawyers, their fees and the expense and delay of litigation. We followed the procedures in the statute in order to provide a prompt resolution of the Kitec issue for our homeowners.

We do not agree with the class action lawyers who filed this lawsuit that any offer made by Pulte/Del Webb under NRS Chapter 40 to homeowners who they claim are members of the class must be approved by the judge in their case.

In the meantime, we intend to continue issuing checks to Sun City Anthem homeowners who have signed and returned properly executed releases, and where an inspection has confirmed the presence of Kitec. Due to the large number of homeowners involved and uncertainty caused by pending court decisions, some delays have occurred with inspections and distribution of checks.

We have already issued checks to a number of homeowners. We plan to distribute checks to all remaining qualifying homeowners, approximately 2,000, within the next two weeks. If you have returned a properly executed release and have had your home inspected by a Pulte/Del Webb consultant, there is nothing further you need to do.

However, in light of the court’s ruling, we cannot continue to perform inspections. For those homeowners who have returned releases but have not had inspections, we will not be able to issue checks at this time. Again, we strongly disagree with the court’s ruling and sincerely apologize to those homeowners for t the inconvenience created by the class action lawyers.

For those homeowners who have returned a properly executed release, but have not had an inspection performed by a Pulte/Del Webb consultant, you may still qualify to receive the $7,800 by providing written certification from your own inspector or plumber that your home contains a Kitec plumbing system. . You must also certify by signing the statement from the inspector or plumber that your home contains Kitec. A copy of an invoice can be used as certification, but is not required. Upon receipt of the certification, we will issue a check to you within two weeks.

For homeowners who returned a properly executed release and had work done before an inspection was performed, you may submit a copy of the plumber’s invoice in lieu of a written certification from the plumber. In that case, you will also need to sign the invoice to certify that your home had a Kitec plumbing system.

        If landscaping is not installed by April 29, 2007, to be deemed a continuing violation and a fine be imposed in the amount of $100.00 each week to begin April 29, 2007 until landscaping is installed.

      2. Incomplete Landscaping - CC&Rs Article IV.4.3(b)
        Case Nos. 613, 619, 620, 621 and 623
        If landscaping is not complete by April 29, 2007, to be deemed a continuing violation and a fine be imposed in the amount of $50.00 each to begin April 29, 2007 until landscaping is completed.

      3. Maintenance of Landscaping - CC&Rs Article V.5.1.
        Case Nos. 623 and 624
        If landscaping is not installed by April 29, 2007, to be deemed a continuing violation and a fine be imposed in the amount of $100.00 each week to begin April 29, 2007 until maintenance is corrected.
        Staff Recommendation: Approve all of the above.

    4. Enforcement Department –
      The Covenants Committee hearing panel reviewed the following cases presented by the Enforcement Department on 3/14/07. The Covenants Committee recommends the Board of Directors approve the following fines:

      1. Case # 07-09 – Violation of CC&R, Article 2 as amended and Article 3.1(b) Age Restriction, as amended.
        Recommendation - $100.00 initial fine be imposed on 4/6/07. If not cured, then starting on
        4/20/07 a continuing violation fine of $100.00 every seven days thereafter until cured.

      2. Case # 07-10 – Violation of CC&R 3.6(a), Animals and Pets, 3.6(g) storage, and 3.6(l)
        Unsightly or Unkempt conditions.
        Recommend $1,000.00 (one thousand dollar) initial fine to be imposed on 4/6/07. If not cured,
        then starting on 4/20/07 a continuing violation fine of $50.00 each and every day thereafter
        until cured.
        Note – The recommendation of the Hearing Panel reflects their decision that this violation impacts the health, safety, and welfare of the Community.

      3. Case #’s - 07-12, 13, 14, 15, 16, 17, 18 – Violations of CC&R, Article 2 as amended
        and Article 3.1(b) Age Restriction, as amended.
        Recommendation - $100.00 initial fine be imposed on 4/6/07. If not cured, then starting on 4/20/07 a continuing violation fine of $100.00 every seven days thereafter until cured.

      The following were approved by the ARC at their business meeting on March 13, 2007.

      1. Item 2007-3-1 - Augusta Turf was approved for installing synthetic turf in Sun City Anthem.

      2. Item 2007-3-2 - A 200 square foot front addition was approved to be built by Bennett Builders.

      3. Item 2007-3-3 - A 96 square foot rear yard addition was approved to be built by Bennett Builders.

      4. Item 2007-3-4 - A 468 square foot casita was approved to be built by Bennett Builders.

      5. Item 2007-3-5 - A 504 square foot rear yard addition was approved to be built by Bennett Builders.

      6. Item 2007-3-6 - A 316 square foot front addition was approved to be built by American Remodeling.

      7. Item 2007-3-7 - Developer wall alteration for removal of one course of block for infinity edge pool was approved.

      8. Item 2007-3-8 - A 429 square foot casita was approved to be built by Bush Construction.

The Minuteman Foundation is the organization which provides the funding needed to support the activities of the Community Service Club. The Foundation is a 501 (c) (3) charity.

The goal of The Minuteman Foundation is to fund the many and diverse needs of the elderly in each and all of our growing communities.

Pursuant thereto we have allied with the Community Service Club to provide free assistance to SCA residents. The services included are:

Transportation:
To local area medical providers or supermarkets. Three (3) business days notice required to arrange for your ride.

Equipment: We will loan you (on a temporary basis) a wheelchair, walker, crutches, cane, or other durable medical equipment.

Home Maintenance: Assistance with minor home maintenance chores such as: cleaning or replacing overhead air filters, replacing batteries in smoke alarms and carbon monoxide (CO) detectors, or changing overhead light bulbs.

Home Assistance: Resource Directory of information on fee-based, discount, and many other services available to seniors. Volunteers will also shop and deliver groceries or prescription medication to residents who are temporarily homebound.

Support Groups: CSC sponsors several support groups to assist the residents of Sun City Anthem. These groups are:

  • Living “Well” with Disabilities (physical mobility)

  • Alzheimer’s Caregivers
    3rd Monday, 6:30—8:30 p.m., Former Sewing Room

  • Bereavement — please call 614-5862 for information.

  • One on one guidance through Jewish bereavement protocol

  • One on one grief counseling for loss of a child

  • Friends of Bill W. Meeting of Alcoholics Anonymous -
